Premier Loyalty Program Terms and Conditions

These Terms and Conditions (“Agreement”) govern the Premier Loyalty Program (“Program”) offered by Premier Automotive C of Carlsbad LLC dba Premier Chevrolet of Carlsbad, Premier Automotive K of Carlsbad LLC dba Premier Kia of Carlsbad, and Premier Automotive BCG of Carlsbad LLC dba Premier Buick Cadillac GMC of Carlsbad (“Premier of Carlsbad,” “Dealer,” “we,” “us”). By purchasing a vehicle or participating in any Program benefit, you (“Customer,” “you”) agree to be bound by this Agreement. This Agreement is governed by the laws of the State of California.

1. Program Overview. The Premier Loyalty Program provides eligible customers with a suite of benefits tied to new and pre-owned vehicle purchases at Premier of Carlsbad. Benefits are non-negotiable in value and cannot be applied toward the vehicle purchase price except for Rewards. Benefits are only available so long as you own the covered vehicle and Premier of Carlsbad operates as a motor vehicle dealer or service facility.
2. Benefit Descriptions and Conditions

Lifetime Powertrain Protection (New Vehicles Only). Except for the Standard Exclusions below, it covers the engine block and all internally lubricated parts, transmission, and all internal parts, transfer case, and front and rear drive axles. Coverage is activated at time of purchase and remains in effect for the duration of original customer ownership or until Premier of Carlsbad ceases operating as a motor vehicle dealer or service facility, whichever occurs first.

Standard Exclusions:

• Wear items: belts, hoses, seals, gaskets, spark plugs, filters, fluids
• Damage caused by accident, collision, theft, vandalism, fire, or flood
• Damage resulting from lack of maintenance, overheating, or operation without adequate fluids
• Damage from modifications, aftermarket parts, or non-OEM components
• Damage from racing, off-road use, or use exceeding manufacturer GVWR
• Pre-existing conditions present at time of purchase
• Consequential or incidental damages
• Coverage voids upon sale, trade, transfer, or total loss of the vehicle

Claims must be presented to a participating Premier of Carlsbad service facility. Coverage is non-transferable and terminates upon any change of vehicle ownership or if Premier of Carlsbad ceases operating as a motor vehicle dealer or service facility.

Lifetime Engine Protection (New & Pre-Owned Vehicles).Except for the Standard Exclusions above under Lifetime Powertrain Protection, the Lifetime Engine Protection covers the engine block and all internally lubricated parts. Applies to all new and pre-owned vehicle purchases at Premier of Carlsbad. Claim procedures and exclusions mirror those listed under Lifetime Powertrain Protection above. Coverage is non-transferable and terminates upon any change of vehicle ownership or if Premier of Carlsbad ceases operating as a motor vehicle dealer or service facility.

Complimentary Oil Change (New Vehicles Only). One complimentary standard oil change included with every new vehicle purchase. Redeemable at any time during original ownership of the vehicle. Excludes electric vehicles (EV models). Valid only at Premier of Carlsbad service departments. No cash value. Non-transferable. Limit one per new vehicle purchase.

$250 Off Collision Center Deductible (New & Pre-Owned Vehicles). Receive a $250 credit toward your insurance deductible for repairs performed at the Premier of Carlsbad Collision Center. Limit one redemption per vehicle purchased. No cash value. Non-transferable. Must present proof of vehicle purchase at time of collision center intake.

Uber / Lyft Transportation Benefit (New & Pre-Owned Vehicles). Complimentary Uber or Lyft ride provided to and from Premier of Carlsbad during paid service visits. Maximum distance of 20 miles from Premier of Carlsbad one direction. Available during Premier of Carlsbad service hours only. Only available for customer pay visits, not available on warranty only repairs. Premier reserves the right to modify or discontinue this benefit with 30 days’ notice.

Premier Rewards Program Enrollment (New & Pre-Owned Vehicles). All vehicle purchasers and service customers are automatically enrolled in the Premier Rewards Program at no cost. Members earn:

• 5% of eligible paid service amounts, credited toward future service visits at Premier of Carlsbad
• 5% of eligible paid service amounts, credited toward a future vehicle purchase at Premier of Carlsbad

Rewards will expire after 24 months if rewards are not redeemed or earned within the 24-month period. The maximum amount of rewards that can be used per visit is $250.00 for a single service visit and $500.00 for a single vehicle purchase.

Rewards are not redeemable for cash. Rewards credits have no cash value and are non-transferable. Premier reserves the right to modify reward percentages, redemption rules, or discontinue the Rewards Program with 30 days’ written or electronic notice. Right to redeem rewards automatically terminates if Premier of Carlsbad ceases operating as a motor vehicle dealer or service facility.

3. General Terms

Eligibility. All benefits are available exclusively to the original purchasing customer. Benefits are non-transferable and void upon sale, trade, or transfer of the vehicle to any third party, unless otherwise stated herein.

Participating Locations. Benefits are valid only at participating Premier of Carlsbad locations. Service-based benefits must be redeemed at Premier of Carlsbad unless otherwise designated in writing by Premier of Carlsbad.

No Cash Value. No program benefit has cash value. Except for Rewards, benefits may not be applied toward the purchase price of a vehicle.

Modifications and Termination. Except for Lifetime benefits, Premier of Carlsbad reserves the right to modify, suspend, or terminate any Program benefit at any time, with 30 days’ written or electronic notice or by updating these Terms and Conditions except where prohibited by applicable law. All benefits terminate if Premier of Carlsbad ceases operating as a motor vehicle dealer or service facility.

Limitation of Liability. To the maximum extent permitted by California law, Premier of Carlsbad’s liability under this Program is limited to the cost of the applicable covered repair, uber/lyft ride,$250 credit towards collision deductible, the fair market value of the vehicle, or reward value, whichever is larger. Premier of Carlsbad is not liable for incidental, consequential, or indirect damages arising from Program participation or benefit denial.

Dispute Resolution .Any dispute arising under this Agreement shall be governed by the laws of the State of California, with venue in San Diego County. Customers may also contact the California Department of Consumer Affairs or the Bureau of Automotive Repair regarding vehicle service disputes.

NOTICE: All benefits subject to exclusions and limitations described herein. Valid only at participating Premier of Carlsbad locations. Lifetime benefits are non-transferable and terminate upon change of vehicle ownership or if Premier of Carlsbad ceases operating as a motor vehicle dealer or service facility, whichever occurs first. Premier of Carlsbad reserves the right to modify or discontinue any benefit other than the lifetime benefits at any time. This document does not constitute a warranty under California Civil Code or the Magnuson-Moss Warranty Act nor is it a service contract. Battery for Life Warranty, where offered, is governed by separate warranty document and is not a part of this Agreement.
